Statement of the Revekoll COMPANY, Karzcino 30A, 76-200 Słupsk,
on providing information on the ownership of the right to an industrial design and the possible consequences of its violation.
This declaration aims to avoid possible infringement of rights to an industrial design, and thus to avoid civil and/or criminal disputes arising from the infringement of the rights to the industrial design in question, and laid down in the provisions contained in the Act of June 30, 2000 Property Law industry (consolidated text of 2017, item 776), and in particular the provisions contained in Art. from 287 to 291.
Subject of the statement:
The Revekoll company, 76-200 Słupsk, Karzcino 30A is the owner of the industrial design entitled Metal fence panel whose application has been registered
at the Patent Office of the Republic of Poland under the number Wp. 26617 . Figures of this template form Annexes 1 and 2 to this declaration.
In connection with our placing on the market, including by submitting a commercial offer, we would like to inform you that the subject of this offer or the Metal the fence panel presented in the attached drawings is subject to legal protection resulting from the provisions of the Act of June 30, 2000, Industrial Property Law, in particular Art. 105 paragraph. 2 and 3, which say that:
By obtaining the right from registration, the entitled person acquires the exclusive rights to use the industrial design for profit or professional purposes throughout the territory of the Republic of Poland and the entire European Union.
The entitled person may prohibit third parties from manufacturing, offering, placing on the market, importing, exporting or using products in which the design is included or applied, or from storing such a product for such purposes.
In addition, imitation of products may violate the provisions of the Act of April 16, 1993 on combating unfair competition
(Journal of Laws 1993 No. 47 item 211) and the Act of February 4, 1994 on copyright and related rights.
Therefore, we declare that in the event of a possible violation of our rights, we will pursue claims in accordance with applicable law.
